Oregon agriculture department announces 2012 pesticide violations and fines

The Oregon Department of Agriculture announced it issued 26 fines for pesticide violations in 2012. The total fines amounted to nearly $50,000.

Companies and individuals assessed civil penalties were:

Asplundh Tree Expert Co., Tigard -- $2,849 fine for seven counts of employing unlicensed pesticide applicators.

Jeremy J. Breyman, Salem -- $407 fine for applying pesticide in a faulty, careless, or negligent manner.

Coastal Farm & Ranch, Albany -- $320 fine for selling products in broken containers.

Crop Production Services, Inc., Tangent -- $888 fine for selling restricted-use pesticide to an improperly licensed person.

Dennis' 7 Dees Landscaping, Inc., Portland -- $3,256 fine for eight counts of employing unlicensed pesticide applicators.

DW Ag Service, Hermiston --$518 fine for applying pesticide in a faulty, careless, or negligent manner. In addition, Dennis A. Winters of Hermiston was fined $407.

EZ Orchards, Inc., Salem and Lorenzo Zepeda, Salem -- $8,000 fines each for applying pesticide in a faulty, careless, or negligent manner.

Michael S. Flood, Hood River -- $3,848 fine for applying pesticide in a faulty, careless, or negligent manner.

Grass Growers, Inc., Baker City -- $2,400 fine for using improperly licensed pesticide applicators.

Nicholas T. Halousek, Malin -- $407 fine for applying pesticide in a faulty, careless, or negligent manner.

Highlanders Forest LLC, Central Point -- $2,700 fine for nine counts of employing unlicensed pesticide applicators.

Home Depot USA, Inc., Ontario -- $360 fine for selling products in broken containers.

JR Simplot Company, Boise -- $1,998 fine for selling restricted-use pesticides to an improperly licensed individual. The company was also fined $1,440 selling unregistered pesticide products.

Mark D. Lafayette, Dallas -- $814 fine for applying pesticide in a faulty, careless, or negligent manner.

Alex Lagunas, Klamath Falls -- $7,215 fine for applying pesticide in a faulty, careless, or negligent manner.

Mid-Columbia Producers, Inc., Moro -- $444 fine for intentionally or willfully applying a pesticide inconsistent with its labeling. Ken R. Dunn of Wasco and Paul M. Keyes of Dufur were each fined $407 for their role in the incident.

Oregon Field Spraying LLC, Carlton -- $407 fine for applying pesticide in a faulty, careless, or negligent manner. Eric J. Kuehne, Carlton, also was fined $407.

Trugreen Landcare LLC, Tigard -- $555 fine for employing an unlicensed pesticide applicator.

Univar USA, Inc., Portland -- $407 fine for selling restricted-use pesticide to an improperly licensed individual.

Sheldon Virgin, Keizer -- $555 fine for applying pesticide without a license.

Individuals receiving civil penalties from the Oregon Department of Agriculture can request an administrative hearing to contest the fine.
